Legal Status mushroom grow kits depends on National law

A lot of questions are being ask on the legality of Mushrooms, grow kits , spores and truffles. It is difficult to keep track on individual or national laws (some not provide in English, makes it hard to read) some change to a more liberal of coping with the cultivation or use of mushrooms other countries get more strict and tighten the web of laws and rules and prohibit sales, use and cultivation of mushrooms.

At the end of this post there is an EU-publication about the legal status of mushrooms. Noting has been said about grow kits, truffles or spores. If you as a reader has any information or English versions of your national law please feel free to comment (as well on other issues).

The Dutch-case: Mushrooms and truffles

The Netherlands with it's liberal rules on drug use was the example for other countries (and some film makers) to use in positive or negative way to form their own laws/visions on drug use. But with the ban on first dried and in 2008 fresh mushrooms an end came to the liberal laws. The next step is prohibit cannabis for tourist and nobody will be surprised if the government or future governments will prohibit cannabis for Dutch citizens also. So when Portugal en the Czech Republic have change there attitude to drugs-use and adopt there own version of the Dutch 'gedoogbeleid' the Dutch State is turning it's back to it's liberal past. Under pressure of nieghbor countries France and Germany, The European Commission and a more conservative Dutch government laws are changing for us and restricting personal use, experience and forcing mind exploring people in to criminals.

But again there is still hope because not all laws can be forced upon us over a forth night. Still truffles, mushroom grow kits and spores are legal to own and purchase in the Netherlands. Also the picking of natures gift the mushroom is in no way illegal.

Legal status of hallucinogenic mushrooms in European Counties

This article is from the EMCDDA an EU organisation on monitoring drugs and drugs addiction. The table with laws and restrictions is lasted update on 30th of April 2010 it is possible that not all information is actual and changes could be made in the laws of your country. As you can read below some European States restrict the mushroom it self other prohibit psilocin or psilocybin. The mushroom grow kit are containing hibernating mycelia which contains a very small 0,0 something % of psilocin/ psilocybin, however small percentage is this can still be enough to get them restricted in your country. Spores vials or prints are containing no trace of these substances and possesion is in most cases accepted. (no source for this information)

Notice also this sentence “cultivation of any plant for the purposes of making a psychoactive substance” if it's in your national law your are clearly not in liberty to grow for personal use. But laws can be, will be and are interpreted in other ways (in other times)

Mushrooms containing psilocin or psilocybin are known as hallucinogenic or "magic" mushrooms. Psilocin and psilocybin are controlled substances under Schedule 1 of the 1971 UN Convention on Psychotropic Substances, so all Member States control them accordingly. However, the control of the mushrooms themselves is interpreted in many different ways across Europe – this may reflect the extent to which they grow freely in certain conditions, and the fact that they appear to be a somewhat regional phenomenon.

In some countries, the law specifically lists hallucinogenic mushrooms themselves as a controlled substance and forbids their sale or possession.Some will simply treat the mushrooms as being the controlled substances of psilocin or psilocybin in compound form.Some look at the intent of the act; they ban cultivation, possession or sale only when for the purposes of abuse. Their condition is also considered – fresh mushrooms might not be considered illegal, but prepared or treated mushrooms are illegal – again perhaps reflecting the intent.Interpretation of the term “prepared” or “treated” may become a complex matter for the courts.Others use a catch-all phrase in the law (“cultivation of any plant for the purposes of making a psychoactive substance”).Finally, a number of countries remain with unclear legislation, simply as there have been so few cases that have come to court.

'Magic mushroom therapy' to treat depression could happen in UK inside a year

A clinical trial of 'magic mushroom therapy' could take place in the UK within a year following two ground-breaking studies.

Doctors plan to treat depressed patients who cannot be helped by modern drugs or behaviour-based psychotherapy with the active ingredient in hallucinogenic mushrooms.

Psilocybin infused into bloodstreams

Psilocybin would slowly be infused into their bloodstreams while they receive a carefully tailored 'talking therapy'.

The controversial trial is planned by Professor David Nutt, from Imperial College London, who three years ago was sacked as the Government’s chief drug adviser.

Prof Nutt, former chairman of the Advisory Committee on the Misuse of Drugs (ACMD), clashed with then Home Secretary Alan Johnson after criticising the decision to toughen the law on cannabis.

Earlier tests in the 50/60's stopped

In the 1950s and 1960s, scientists investigating drugs such as LSD and psilocybin carried out studies on around 40,000 patients and published 1,000 papers.

Such work was brought to an abrupt halt when the drugs came to be seen as social evils and were made illegal.

How to pick the mushrooms from a mushroom grow kit ?

Most of the time you can pick the mushrooms within 10-12 days (or a bit more) after the first pins start to show.

The P.Cubensis has a veil between the cap and the stem that covers the gills. The best time to pick them is before the veil breaks from the stem or cap.

The mushrooms will release the spores from the gills and all the spores are lost in the grow kit when this happened.

This as no consequence for the mushrooms them selves, you only have no spores to make a spore print (L) or spore syringe (L) and the mushrooms look black because they are covered in the spores.

We all know the mushroom, but were do these little things come from? They grow out of the mycelium. The mycelium is the vegatative part of a fungus. And it looks like thread or a web. Through the mycelium the fungus gets it's nutrition.

If you have a mushroom grow kit you can see the mycelium through the sides of the box. (Add picture of side box) The mycelium is spread out through the grow kit feeding on the rye substrate.

A Mushroom is the fruiting body of the fungus. It the part of the fungus we see above ground and sometimes eat. Most of part the fungus is living underground and is called mycelium (link).

The mushroom has a cap that contains the spores. The spores are in the gills underneath the mushroom cap. The cap rests on the stem that grows out of the ground.

When the mushroom is small they are called pin. The pin can grow very fast in to a full size mushroom. If you have your own mushroom grow kit you can actually see the pins grow. If the pin doesn't grow it gets the name abort.

Some mushrooms can be eaten others are poisonous, or psychoactive. The psychoactive mushroom are know under a wide variety of names. Psilocybin Cubensis is the most commonly used and know under the name of magic mushrooms.

Een post eerder zijn op het blog de kamervragendie L.Bouwmeester van de PvdA stelde gepubliceerd. Het Kamerlid stelde deze vragen naar aanleiding van een krantenartikel in de Trouw over het gebruik van Sclerotia, beter bekend als Magic Truffels.

De verantwoordelijke minister Schippers heeft antwoord gegeven, deze antwoorden willen wij U natuurlijk niet onthouden. Probeer wakker te blijven tijdens het lezen, de antwoorden zijn niet door mij aangepast. Dus pak een truffeltje en veel plezier.

De antwoorden (met vragen)

Antwoorden van minister Schippers (VWS) mede namens minister Opstelten (V&J) op vragen van het kamerlid Bouwmeester (PvdA) over psychedelische truffels.

1 Heeft u kennisgenomen van de artikelen ‘Psychedelisch truffel net zo populair als eerder de paddo’ en ‘Truffelverbod stimuleert synthetische drugs”?

1 Ja.

2 Is het waar dat psychedelische truffels niet onder een van de lijsten van de Opiumwet vallen? Zo ja, was dat bekend toen de paddo’s op de lijst van de Opiumwet werden geplaatst?

2 De psychedelische truffels of sclerotia vallen niet onder de Opiumwet. Dit was bekend toen de 186 soorten hallucinogene paddenstoelen per 1 december 2008 op lijst II van de Opiumwet werden geplaatst.

3 Is het u bekend dat, sinds het verbod op paddo’s er is, er een verschuiving plaatsvindt van het gebruik van paddo’s naar psychedelische truffels? Zo ja, heeft u met dit effect rekening gehouden op het moment dat u paddo’s ging verbieden?

3 Met een dergelijke verschuiving is rekening gehouden, in zoverre dat een verschuiving als gevolg van de introductie van het verbod op de teelt en de verkoop van hallucinogene paddenstoelen niet uit te sluiten is. In antwoord op eerdere vragen van het lid Joldersma van uw Kamer heeft mijn ambtsvoorganger reeds aangegeven dat uit onderzoek van de VWA uit 2002 is gebleken dat sclerotia een lagere waarde aan hallucinogene stoffen bevatten dan hallucinogene paddenstoelen (Tweede Kamer, vergaderjaar 2008–2009, Aanhangsel, nr. 1509).

4 Deelt u de mening dat het vrijwel onmogelijk is om een verbod op hallucinerende of psychedelische middelen door middel van plaatsing op een lijst te handhaven aangezien er steeds nieuwe middelen met een dergelijke werking ontdekt worden die in de natuur aanwezig zijn? Zo ja, deelt u dan ook de mening dat het beter is om mensen te informeren en adviseren over het gebruik ervan, in plaats van het steeds verbieden van deze middelen om, vervolgens te moeten constateren bij dat er bij de handhaving achter de feiten wordt aangelopen? Zo nee, kunt u dan met cijfers onderbouwd aantonen dat het verbod op paddo’s daadwerkelijk tot een vermindering van het gebruik van hallucinerende, psychedelische of vergelijkbare drugs heeft geleid?

4 Die mening deel ik niet, aangezien het paddo verbod wel degelijk succesvol is gebleken in het tegengaan van het aantal incidenten. Er zijn alleen cijfers beschikbaar van Amsterdam over het aantal gezondheidsincidenten (ambulanceritten) gerelateerd aan hallucinogenen, voornamelijk paddo’s en sclerotia. Daaruit blijkt dat het aantal incidenten is gedaald van 149 in 2007 tot 69 in 2010.

5 Kent u alle middelen die wereldwijd in de natuur bekend staan vanwege hun hallucinerende of psychedelische werking? Zo ja, hoe kunt u die allemaal kennen en bent u voornemens die allemaal te gaan verbieden? Zo nee, wat zegt dat dan over de waarde van het opnemen van paddo’s op lijst 2 van de Opiumwet?
6 Deelt u de mening dat de natuur zich niet laat afremmen door wetten en dat de lijsten met hallucinerende middelen nooit compleet kunnen worden? Zo ja, erkent u dan dat beter ingezet kan worden op voorlichting zodat mensen zich bewust worden van de producten die ze gebruiken? Zo nee waarom niet?

5 en 6 Het is onmogelijk wereldwijd alle middelen te kennen, maar de meeste middelen met hallucinerende of psychedelische werking die in Nederland worden verhandeld zijn bekend. Het plaatsen van hallucinogene middelen op een van de lijsten van de Opiumwet heeft alleen zin als er sprake is van een zekere mate van bestendig gebruik en er sprake is van aantoonbare gezondheidsschade en schade voor de samenleving. In het geval van de hallucinogene paddenstoelen was er sprake van een bepaalde groep mensen die deze middelen op onverantwoorde wijze gebruikte. Na de introductie van het verbod is het gebruik van deze hallucinogene paddenstoelen aanzienlijk afgenomen en daarmee ook de met dit gebruik samenhangende schade. Een en ander laat onverlet dat naast een verbod goede voorlichting over de effecten en de risico’s van deze middelen van belang is. Het een sluit het ander niet uit.

7 Heeft u kennisgenomen van het feit dat psychedelische truffels worden verkocht in souvenirshops? Deelt u de mening dat dit onwenselijk is en dat het beter is om de verkoop te reguleren via verkooppunten die verantwoord om gaan met het verstrekken van drugs zoals de meeste coffeeshops? Zo ja, hoe gaat u die gereguleerde verkoop bewerkstelligen? Zo nee, waarom vindt u het beter om psychedelische truffels via souvenirshops te laten verkopen?

7 Ik heb daarvan kennisgenomen. Het gaat hier echter niet om middelen die onder het regime van de Opiumwet vallen, maar om legale producten, die onder het regime van de Warenwet vallen. Het heeft mijn voorkeur dat dergelijke producten alleen via de zogenaamde smartshops worden verkocht, omdat er dan sprake is van een meer restrictief verkoopbeleid en van voorlichting tijdens de verkoop. Vooralsnog zie ik geen reden voor het introduceren van maatregelen die leiden tot een gereguleerde verkoop van deze truffels.

In een volgende Post zal ik de antwoorden van de Minister van commentaar voorzien. Er wordt namelijk nog al wat gezegd en beweerd in de antwoorden zonder terug te kijken naar de gebeurtenissen in het verleden.

Tweede kamerlid Lea Brouwmeester heeft op haar persoonlijke website de kamervragen gepost welke zij ,na aanleiding van het krantenartikel in dagblad De Trouw, in het parlement heeft gesteld. Om iedereen voldoende te informeren over de opleving van het paddenstoelen en truffel topic hebben wij (MMS) deze vragen op een rij gezet. Hopelijk worden de Ministers in het Kabinet eens wijs en zorgen zij voor een goede regulering in de verkoop van truffels.

There are different ways to start a grow kit or mycelium box please look at the strain of your kit and follow that instruction.

These instructions will work for most grow kits purchased online. What can different? :

The soaking time 6-24 hours
The use of a fork to puncture the substrate for the water.

You have purchased a magic mushrooms grow kit, how do I proceed?

After you have soaked your grow kit for twelve hours, you continue with the next video:

Now put your grow kit on a warm spot (between 20°C and 25°C),but not in direct sunlight.

Under these condition you will be harvesting your first fresh mushrooms after little more than two weeks.

After the harvest you should not throw out your grow kit, because you can do the steps shown in both video’s over and over until your kit is depleted. Sometimes even up to four harvest can be obtained.
